THIS IS AN IMPORTANT DOCUMENT – PLEASE ENSURE THAT YOU READ CAREFULLY. THESE TERMS AND CONDITIONS ARE PART OF YOUR AGREEMENT.

Please read this document carefully. If you do not understand something, ask us or seek advice.

  1. Pre-exercise Screen and Waiver Form - Members must complete and agree to the waiver form prior to participating in any activities at Empire Strength Co.

  2. Cooling Off Period - All agreements are subject to a seven (7) day cooling off period. Cancellation requests must be submitted via the online cancellation form

  3. Ongoing Membership Agreement: After the expiry of the minimum term (three months) membership fees will continue to be debited from your nominated account until the agreement is terminated. If you terminate the agreement or stop the debit arrangement in a manner not described in the agreement, then you may be liable for damages for breach of contract. 

  4. Minimum Age - The minimum age for training at Empire Strength Co. is 16. People under the age of 18 are required to have a parent or guardian co-sign both waiver and membership agreement. For group sessions participants  under the age of 18 are required to have a parent or guardian over the age of 18 attend each session with them until the coach is satisfied with their ability to attend on their own.  

  5. Your Health - A safe and effective exercise program is dependent upon accurate health and fitness profiling. It is therefore essential that you tell us in writing all relevant personal health and fitness information both before (through our pre-exercise questionnaire) and during the course of any exercise program or other activity. You promise that information you disclose to us will be true and accurate and not misleading in any way. You must not attend and use the facilities and services whilst you are suffering from any illness, disease, injury or other condition that could present a risk to the health or safety of other members and guests or yourself. If you happen to use the facilities and services before disclosing relevant health information to us, you promise that you are in good physical condition and you do not know of any reason why you may not be able to exercise safely.

  6. General Conditions of Entry: 

    1. No Smoking – Empire Strength Co. is a non-smoking facility

    2. Dress Code – Fully enclosed, clean sports shoes must be worn during workout for safety reasons

    3. Proper Use of Equipment – Care must be taken when using the facilities and services at Empire Strength Co. Make sure that any equipment is used appropriately and safely as per instructions from Empire Strength Co. certified instructor 

    4. Towels – You are required to use a towel when participating in classes and Personal Training to help maintain hygiene and safety standards

    5. Illegal Activities – No illegal activities are permitted at Empire Strength Co. 

    6. Personal Training – Personal Training services are available at Empire Strength Co. for an additional fee 

    7. Valuables and Lost Property – Empire Strength Co. are not responsible for any loss of, or damage to, personal property at the facility. It is recommended that valuables are not brought into the facility. Any items left at the facility or handed into reception will be held for four (4) weeks and then donated to charity

  7. Payment of Fees - Empire Strength Co. will periodically debit the nominated account for the agreed amount for gym membership fees as stated in the membership agreement. Payments will come out of your account weekly.​
  8. Member Responsibilities - As a member of Empire Strength Co. you must ensure that your account can accept direct debits, there is sufficient available funds within the nominated account on the payment day & any changes to accounts or credit cards are updated via members app (Glofox) at least 24 hours  (one [1] day) before your next payment

  9. Declined or Failed Payment - In the event of a declined or failed direct debit access to Empire Strength Co. will be suspended until payments are up to date and any changes to account details have been confirmed. Empire Strength Co. will continue to debit your account without notice, until we have received the total amount owing. Empire Strength Co. will make a reasonable effort to let you know in advance by phoning you, speaking to you at our facility or in writing.

  10. Late Cancellation/No show Fees - We all have good intentions of getting to our booked sessions at Empire Strength Co., but realistically there are days when making a class just isn't going to happen. On those days, it is important to keep our NEW cancellation policy in mind to avoid being charged any extra fees. At Empire Strength Co. we ask that you cancel any class reservations up to thirty minutes (30) prior to a class's starting time so that someone else can experience the great workout you’ll be missing. If you need to cancel a class, the following cancellation fee structure will apply:

    • Early Cancel ($0) - If you can no longer make the class and cancel at least 30 minutes before the class start time, you will not forfeit the session or pay a fee.

    • Late Cancel ($5) - If you cancel within 30 minutes of class start time, you will forfeit the session (for any 'Credit Based' memberships) or you will be charged a once off cancellation fee of $5

    • No Show ($10) - If you do not cancel your class prior to the class start time and do not attend, you will forfeit the session (for any 'Credit based' membership) or you will be charged a once off no show fee of $10

    • PLEASE NOTE: If there should be a sudden emergency within the 30 minute window, please contact us directly ASAP to avoid the cancellation fee being charged.

    • If you are ill and unable to attend a scheduled class, please ensure you cancel outside of the 30 minute window. If you need to cancel within 30 minute of the start time of your scheduled class, please let us know immediately to avoid the cancellation fee being charged. Please note; if unwell you will not be able to attend classes for 72 hours post notification/late cancel.

  11. Freezing Your Membership

    • Membership can be placed on hold at any time for a minimum of two (2) weeks and a maximum of six (6) weeks. If we agree, your membership may be placed on hold for more than this for travel, medical or hardship reasons but you may be required to give us proof.

    • Freezing your membership must be submitted via the online ‘Request to Hold’ form.

    • This must be completed at least one (1) week or seven (7) days prior to freezing your membership. Membership holds cannot be backdated. Your contract will be extended for the duration of your membership freeze.

  12. Termination of Membership 

    • After the initial 3 month term Agreement, this Agreement will continue until terminated by you

    • Payments will continue until notified. You may terminate your agreement by providing us seven (7) days written notice

    • All termination requests must be submitted via our online ‘Request to Cancel’ form 

    • Upon termination any outstanding balances and/or cancellations are payable immediately. 

    • The cancellation fee is 100% of the payout figure equal to the membership fees that you would have paid for the remainder of the agreement as of the cancellation date.

    • Termination requests for relocating (more than 40km from the facility) with supporting documents must be submitted fourteen (7) days prior to termination to avoid any cancellation fees. 

    • Paid In Full will not receive any refund due to termination unless for medical reasons (see no.13)

  13. Termination for Medical Reasons 

    • A member may terminate the Agreement at any time by notifying Empire Strength Co. in writing via online cancellation form and including supporting documentation that to our reasonable satisfaction demonstrated medical incapacity. 

    • If medical incapacity is demonstrated there will be no cancellation fees and membership will be cancelled within seven (7) days of the cancellation request. 

    • Refunds for remainder of contract will only be given to those who have paid in full (non-direct debit memberships)

  14. Change of Details - It is the responsibility of the member to inform Empire Strength Co. of any changes to the Members personal details that are relevant to their contract

  15. Membership Price Increase - Empire Strength Co. reserves the right to increase your fees at any time after your agreement has ended. Empire Strength Co. will make a reasonable effort to inform you of this increase by providing at least thirty (30) days notice in writing. Following such notice, the member authorises Empire Strength Co. to increase debits from nominated accounts.

  16. Variation to Terms & Conditions - Empire Strength Co. reserves the right to alter these terms and conditions at any time providing at least thirty (30) days notice. 

  17. Use of your Image - As a member you agree to allow Empire Strength Co. to take a video or photo to use for promotional purposes from time to time

  18. Inappropriate Behaviour - Empire Strength Co. reserves the right to refuse entry to members if they act unreasonably. Empire Strength Co. may also warn a member that they risk having their membership cancelled without warning if a member behaves in a way that is risky or seriously inappropriate including threatening or harassing others, intentionally damaging equipment and using illegal or performance enhancing drugs within the facility. No refund will be made under such circumstances. Membership will be treated as a termination (refer to 12.) with a cancellation fee being charged.

  19. Complaints Handling - Please submit any complaints via email to [email protected]. Please Include all details relating to your complaint. We will do all that is reasonable and practical to assess the complaint and respond within a reasonable timeframe. 

By signing up to ANY membership at Empire Strength Co. you agree to all of the above terms & conditions.
